GENERAL CONDITIONS

Simply Gascony Limited (company number 07632986) (the "Agent") and also referred to in these booking terms and conditions ("Terms") as "we", "us" or "our", acts as agent for the owners of the properties featured on our website ("Properties") www.simply-gascony.co.uk ("Website").

Reference to "you" and "your" means the first named person on the Booking Form ("Primary Tenant"). By making a booking with us the Primary Tenant agrees on behalf of all persons detailed on the booking form ("Other Tenants"/"Other Members of the Party") that:

i) he/she has read these Terms and has the authority to and agrees to be bound by them on behalf of the Other Tenants;

ii) he/she is over 21 years of age and where booking a property that has age restrictions, he/she declares that all Tenants are of the appropriate ages.

A binding contract between you and the Owner is made when: i) we receive from you payment of your Rent Deposit of 25% of the total rent due ii) we confirm to you by email that we have received your deposit and that we have accepted your completed Booking Form ("Booking Form").

These Terms and the Booking Form set out the details of the Agreement between you, the Primary Tenant, and the owner of the property ("Owner") in respect of your holiday rental ("Holiday") of the property as set out in the Booking Form. The price of the Holiday is as set out in the Booking Form ("Price").

HOW TO BOOK AND PAY FOR YOUR HOLIDAY

Once you have chosen a property please either call us on +44 (0) 7970 698867 between 9am and 6pm or e-mail robin@simply-gascony.co.uk to check that the property is available for the dates when you want to rent it.

On confirmation of the property's availability we will send you a Booking Form and a Rental Invoice setting out the Price. You should return your Booking Form to us by email and at the same time pay the 25% Rent Deposit by a bank-to-bank transfer direct to the Simply Gascony bank account, the details of which will be on the Rental Invoice. Please note that any bank transfer charges are payable by you. On receipt of the completed Booking Form and the Deposit we will send you a Booking Confirmation.

The balance of the Price minus the Deposit ("Balance"), together with a refundable Security Deposit (as defined below), must be paid no less than 9 weeks before the start date of the property rental. Failure to pay the Balance in full and on time means that we are entitled to treat your booking as cancelled by you.

If a property is booked less than 9 weeks before the start of your Holiday, then the full Price is due upon booking. Please note the cancellation charges at paragraph 4 below.

DAMAGE/SECURITY DEPOSIT

If you or any Tenant in your party causes any damage (other than 'normal wear and tear') to the property or any item in it or on its premises, or a requirement for extraordinary cleaning, you will be required to pay the reasonable and justifiable costs of making good such damage. We therefore require that a Security Deposit is paid by you at the same time as the Balance to cover any such damage ("Security Deposit").

The amount of the Security Deposit differs for each property. It will be specified on the Booking Form and on the Rental Invoice.

The costs of any damages, breakages and any extra cleaning required will be deducted from the Security Deposit if we consider that you have left the property in an unacceptable state.

The Security Deposit will be refunded to you within 4 weeks of the end of the rental period less any charges for damages as applicable.

In all matters concerning the Security Deposit or any deductions to be made from it, the decisions of Simply Gascony will be final and binding on both the Owner and the Tenants.

CANCELLATION BY YOU

1. Any cancellation by you must be sent by email to Simply Gascony. Cancellation will take effect on the date we receive notification by you and confirm back to you that we have received this notification. If you do not receive confirmation within 24 hours, you must telephone us to check that your email has been received.

The following cancellation charges will apply if you cancel your Holiday:

i) more than 9 weeks prior to the start date of your Holiday rental period there will be no further charges, but you will forfeit the 25% Rent Deposit;
ii) less than 9 weeks prior to the start of your Holiday rental period then Simply Gascony is entitled to retain the full Balance including Deposit on behalf of the Owner.

CANCELLATION BY SIMPLY GASCONY OR THE OWNER

In the unlikely event that Simply Gascony or the Owner cancels your Holiday or we need to modify any booking, we will notify you as soon as possible.

If Simply Gascony or the Owner cancels your Holiday you will be offered alternative holiday accommodation that matches as closely as possible the property you have booked.

Alternatively, you will have the option to cancel your Holiday and receive a full refund of all monies paid by you up to the date of cancellation.

EVENTS OUTSIDE OUR CONTROL

Except as expressly set out in these Terms, Simply Gascony will not be liable to pay you or any other Tenant any compensation if your holiday is affected by any event that is beyond our reasonable control. These events include (but are not limited to) war, threat of war, terrorist activity and its consequences or the threat of such activity, civil commotion, riot, the act of any government or other national or local authority including port authorities, industrial action by third parties, natural or nuclear disaster, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster or failure of public or private telecommunications networks, or any other form of 'force majeure'. If such an event occurs we will notify you as soon as possible.

TRAVEL INSURANCE

It is a condition of these Terms that all Tenants specified on the Booking Form take out comprehensive travel insurance at the time of booking to cover the duration of your Holiday. This insurance must include travel, cover for personal belongings, personal liability, loss of life, personal injury and medical treatment. We are entitled to ask you to provide us with a copy of your insurance policy or certificate.

MAXIMUM OCCUPANCY

The maximum number of people accepted at the property (excluding infants under the age of 2) is stated in the property description and on the Booking Form, and some property Owners may limit the number of children. Only the Tenants listed on the Booking Form may stay at the property, unless with our prior written agreement.

PRICES

Unless otherwise stated, all property Prices include utilities, linen and towels. In low and mid season a heating charge may be added for some Properties. You will be advised of this at the time of booking and any additional charges will be set out in the Booking Form. Our Prices may change at any time, but Price changes will not affect your booking once you have received a Booking Confirmation.

COMPLAINTS

If you have a complaint whilst staying at the Property, please contact us immediately by telephone or email so that we can take action to rectify the problem. If you fail to make any claims or complaints to Simply Gascony prior to your departure, this may affect our ability to investigate any complaints and the way in which your complaint is handled.

OUR LIABILITY TO YOU

We act as agent for the property Owners and we have no direct control over the properties. Our total liability to you is limited to a maximum of the Price paid for your Holiday. We do not accept any liability for personal injury or loss to you or any Tenant, or for consequential loss or damage to you/your property, or for any other matters over which we have no control. Additionally, the Owners do not accept liability for personal injury or loss to you or any Tenant or consequential loss or damage to you, other Tenants or your/their property, or for any other matters over which they have no control.

YOUR RESPONSIBILITY

You must keep the property and all furniture, fixtures and fittings in or on the property in the same condition as when you arrive and you must leave the property in the same general state of cleanliness and good order in which you found it, making due allowance for normal holiday usage. We reserve the right to deduct from the Security Deposit the cost of any extra cleaning or repairs if we consider the property is left in an unacceptable state.

It is your responsibility to ensure that all the Tenants in your party behave respectfully and decently.
It is your responsibility to make sure that the property is secure at all times.

You are using the property and its facilities at your own risk. Children must be properly supervised at all times. If the property has a swimming pool it is your responsibility to ensure that the pool security system remains active at all times when not in use.

Every Simply Gascony property has a 'House Book' which explains how things work and where there may be any risks. As part of these Booking Conditions, it is the responsibility of the Primary Tenant to read this House Book and to pass on key information to other adult members of the party.

PROPERTY DESCRIPTION AND FACILITIES

All property descriptions on the Website have been approved by the Owner and, to the best of our knowledge, are correct at the time of publication. Simply Gascony will not be held responsible for any inaccuracy, misinterpretation or dispute that may arise in this respect.

Simply Gascony does not accept responsibility for the failure of facilities at the property including supply of gas, water, electricity, swimming pool filtration systems, domestic or electrical equipment or internet access. Please tell us as soon as possible if you encounter a problem and we will make every effort to solve problems of this nature as soon as we are notified.

ARRIVING AND LEAVING

Unless otherwise arranged with the Owner or Simply Gascony, arrival times at the property are between 16.00 and 19.00 on the first day of your Holiday, and you must vacate by 10.00 am on the day of departure. Any Guests still at the property after 10.00 am on the last day of their Holiday without prior permission from the Owner or Simply Gascony, will be liable to pay extra charges equivalent pro-rata to a whole day's rental, which may be deducted from the Security Deposit.

PETS

Pets are not allowed at any of the properties, unless otherwise agreed in advance in writing with the Owner and/or Simply Gascony.

RESIDENT ANIMALS

Some properties have resident animals (e.g. horses). You will always be informed of any resident animals at a property you are thinking of renting and it is your responsibility to make sure that none of your Party might suffer any allergic reaction to such animals.

SMOKING

Smoking is not permitted inside any of the properties.

OUR RIGHTS

Simply Gascony or the Owner shall be entitled to require that one or more individual Tenants or pets leave the property (as appropriate) immediately if:

i) there are more people staying than the maximum occupancy stated on the Booking Form
ii) a pet is present in the property during your Holiday without the prior agreement of the Owner or Simply Gascony
iii) any activity is undertaken by a Tenant which is illegal, or may in the opinion of the Owner or Simply Gascony cause unreasonable damage, noise, nuisance or disturbance
iv) any Guest contravenes our non smoking policy

PRIVACY

We will use the personal information you provide to us to:

i) process your payment for the Holiday
ii) inform you about Simply Gascony's offers and news; you may choose to stop receiving information from us by contacting us.
iii) We will not pass on your personal information to any third party.

COMMUNICATIONS

All communications between us and you will be by telephone or email and all documents will be sent as emails or as attachments to emails.

All payments/money transfers shall be made by direct bank-to-bank transfer (e.g. by internet banking or BACS). Cheques, money orders or other paper-based methods are not accepted.

LEGAL

We may transfer our rights and obligations under these Terms to another organisation and we will notify you if this happens. This will not affect your rights under these Terms. It is agreed that you, Simply Gascony and the Owner may in their own right enforce the provisions of these Terms in accordance with the Contracts (Rights of Third Parties) Act 1999 (the "Act") which shall apply to these Terms. A person who is not a party to these Terms has no right under the Act to enforce them.

These Terms and Conditions and the Booking to which they apply are governed in all respects by English law. In the event of any dispute, you, all other Tenants and Simply Gascony all agree to submit to the exclusive jurisdiction of the English courts and any appropriate dispute resolution procedures.
